• This Agreement and Liability Waiver ("Agreement") outlines the terms and conditions governing participation in services offered by Gentle Fight Club ("GFC"), including but not limited to boxing, kickboxing, strength and conditioning classes, and associated activities. By continuing with payment and enrollment in GFC services, the client {name} acknowledges their understanding and agreement to the terms outlined below:

1. Liability Waiver

Assumption of Risk

The client acknowledges and understands that participating in boxing, kickboxing, strength and conditioning, and other physical activities involves inherent risks, including but not limited to physical injury, illness, or death. The client voluntarily assumes all risks associated with these activities, whether on behalf of themselves or their child.

Release of Liability

In consideration of participating in GFC’s activities, the client releases, waives, discharges, and covenants not to sue GFC, its owners, trainers, employees, or affiliates from all liability, claims, demands, actions, or causes of action, including negligence, arising from participation in GFC’s services.

Health and Fitness Representations

The client certifies that they, or their child, are physically and mentally fit to participate in GFC’s activities. The client agrees to disclose any pre-existing medical conditions, injuries, or health concerns.

Emergency Medical Treatment

In the event of a medical emergency, GFC is authorized to obtain necessary medical treatment for the client or their child. Efforts will be made to contact the provided emergency contact, but consent for treatment is granted if contact cannot be made.

2. Auto-Pay Contract and Payment Terms

• Auto-Pay Enrollment: The client agrees to participate in GFC’s auto-pay system for month-to-month payments. Payments will be automatically charged to the payment method on file on the [specific date] of each month.
• Cancellation: A 30-day written notice is required for cancellations. No refunds will be provided for any payments made.
• Promotions: Upon cancellation, any promotional discounts will be forfeited, and no refunds will be issued.
• Rejoining: Clients who terminate their membership and later decide to rejoin will be subject to new member fees and current membership rates. Previous rates or promotions will not be reinstated.

3. No Refund Policy

All purchases, including but not limited to memberships, classes, sessions, or promotional offers, are final. No refunds will be issued under any circumstances.

4. Code of Conduct

The client agrees to:

• Treat all staff, trainers, and fellow clients with respect.
• Follow all rules, regulations, and instructions provided by GFC.
• Maintain a clean and safe environment.
• Refrain from any disruptive or harmful behavior.

5. Photography and Media Release

The client consents to the use of any photographs, videos, or media captured during classes or events for GFC’s promotional and marketing purposes.

6. Payment Responsibility and Failure to Pay

• Updated Payment Method: The client agrees to maintain a valid payment method on file.
• Non-Payment: Failure to provide payment within 5 days of a failed charge may result in suspension or termination of services.

7. Governing Law and Severability

The laws of California shall govern this Agreement. If any provision is found invalid or unenforceable, the remaining provisions shall remain in effect.

8. Confirmation of Terms

The client confirms their understanding and acceptance of this Agreement and Liability Waiver by engaging in GFC's services and completing any associated payment. This Agreement is effective immediately and does not require a signature to be binding.
